Child Support Unit

The District Attorney's Child Support Unit acts as the legal counsel for the DeKalb and Cherokee County Department of Human Resources (DHR). The Unit works in conjunction with DHR to establish & enforce child support orders and to prosecute deadbeat parents for failure to pay child support. The unit is made up of a director, two assistant district attorneys, and support staff.

The services of the Child Support Unit are available to all residents of DeKalb and Cherokee Counties who qualify through the Department of Human Resources. The unit also assists custodial parents residing outside of the Ninth Circuit in enforcing child support orders against parents living in DeKalb and Cherokee Counties.

If you or someone you know needs assistance in establishing or enforcing a child support order, contact the DeKalb County Department of Human Resources at (256) 844-2700 or the Cherokee County Department of Human Resources at (256) 927-1440. Once approved by DHR, a child support case is then referred to the District Attorney's Child Support Unit for appropriate legal action.

Frequently Asked Questions (FAQ)

What are the services available to parents through the Department of Human Resources (DHR)?

DHR performs the following functions:

  • files court action for the adjudication of paternity
  • establishes child support orders
  • collects and enforces child support by income withholding
  • initiates and prosecutes "in contempt" proceedings for failure to comply    with court orders
  • modifies support orders to increase, decrease, or terminate support as     circumstances change

  • Is there any charge for these services?

There are no charges for utilizing DHR services. DHR is authorized by Title IV-D of the Social Security Act of 1975 and Alabama law to provide child support services for any parent seeking the establishment of a parent-child relationship and/or to have child support ordered and enforced.

How does the District Attorney's Office become involved?

An application for services must be made through DHR. The case is then referred to the District Attorney's Office by DHR. The contract between DHR and the District Attorney's Office bars the Child Support Unit from involvement and representation of custody and visitation matters.
